Who Issues the Protection Notice?
A protection notice is requested by the relevant building surveyor.
A protection works notice is usually issued by the builder/developer of the land as agent for the owner of the land where works are being conducted.
What a Protection Notice Does
A protection notice outlines specific requirements and conditions that the construction site must adhere to in order to prevent harm or damage to nearby properties or infrastructure.
Once the notice is issued on the adjoining property owner, a copy is submitted to the building surveyor. They determine within or after 14 days if they are satisfied that the notice adequately covers protection of the adjoining property from the building works.
When is Protection Work Required?
A building surveyor determines when protection is required. Generally, this is requested for works on the adjoining boundary or usually within one meter of the adjoining boundary.
How do I Arrange to Get a Dilapidation Report Prior to Construction
While protection notices are mandatory if ordered, dilapidation reports, in most cases, are not.
If a Melbourne builder doesn’t provide a dilapidation report then it would be in your best interest to obtain one. Engage with our team at Home Building Assist to find out more. We have over 30 years in the residential construction industry and can provide the right advice for your circumstances.
